Terms of Service

These terms apply when a food business ("you") signs up to and uses OrderGURU ("we", "us"). By creating an account you agree to them.
1. The service
OrderGURU provides software for taking and managing online orders, including ordering pages, payments, delivery tools, offers, customer records and reports. We may improve, change or remove features over time, and we will give reasonable notice of any change that materially harms you.
2. Your account
- You must give accurate details and keep your login secure. You are responsible for what happens under your account, including the actions of staff you invite.
- You must be able to enter a binding contract and be authorised to act for the business you register.
3. Fees
- Fees are set out on our pricing page or in any written agreement with you. They may include a monthly charge and a percentage of each order.
- Card payments are processed by Stripe. You must accept Stripe's terms and complete their onboarding. Stripe's processing fees are separate from ours and are charged by Stripe.
- We may change our prices with at least 30 days notice. Changes will not affect orders already placed.
4. Payments and payouts
Customer payments are sent to your connected Stripe account. We deduct our fee at the point of payment. Refunds and chargebacks are your responsibility as the seller, including the cost of any disputed payment.
5. Your responsibilities as a food business
- You are the seller of the food and drink. You are responsible for its safety, quality, pricing, descriptions and preparation.
- You must keep allergen and dietary information accurate and up to date, and comply with all food safety, hygiene, licensing, tax and consumer laws that apply to you.
- You are responsible for delivering orders you accept, and for your customers' data as set out in our Privacy Policy. You must only send marketing to customers who have agreed to receive it.
6. Acceptable use
You must not use the service unlawfully, to sell prohibited goods, to send spam, to attempt to break or overload the platform, to access other businesses' data, or to misrepresent who you are. We may suspend or close accounts that break these rules.
7. Your content and data
You keep ownership of your menus, images, branding and customer data. You give us permission to host and display them as needed to provide the service. We keep our rights in the software and design of OrderGURU.
8. Availability
We work hard to keep the service running, but we cannot promise it will always be uninterrupted or error free. Please have a plan for taking orders another way if it is unavailable.
9. Liability
Nothing in these terms limits liability that cannot be limited by law, including for death or personal injury caused by negligence or for fraud. Subject to that, we are not liable for lost profits, lost sales or indirect losses, and our total liability to you in any twelve month period is limited to the fees you paid us in that period.
10. Ending things
You can close your account at any time. We may suspend or end your access if you break these terms, with notice where reasonably possible. Sections that by their nature should continue, such as fees owed and liability, will continue after closure.
11. Changes to these terms
We may update these terms. We will tell you about material changes in advance, and continuing to use the service afterwards means you accept them.
12. Law
These terms are governed by the law of England and Wales, and the courts of England and Wales will have jurisdiction.
